Terms of Use

These Terms of Use explain the rules and expectations for using Mathnk websites, live tutoring, free assessments, online classes, student workspace tools, recordings, model papers, communications, and related services.

1. Acceptance of These Terms

These Terms of Use are an agreement between Mathnk and the person who accesses or uses Mathnk services. If you use Mathnk on behalf of a student, child, family, organization, or another person, you confirm that you have authority to accept these terms for them.

By accessing Mathnk, registering for a free assessment, creating an account, joining a class, paying for a package, using the student workspace, or communicating with Mathnk, you agree to these Terms and to any additional terms shown during registration, checkout, or enrollment.

If you do not agree with these Terms, you should not use Mathnk services.

2. Mathnk Services

Mathnk provides educational support that may include free assessments, live tutoring, group classes, one-on-one support, student workspace tools, teacher feedback, homework, model papers, recordings, progress information, scheduling, and related communications.

Mathnk currently focuses on subject support such as Math, English, Physics, Chemistry, Coding, and related academic skills. Program availability, subjects, grade levels, schedules, teachers, class sizes, and pricing may change over time.

Mathnk is not a school, degree-granting institution, or substitute for a student's regular school. Mathnk support is intended to supplement learning and help students build stronger skills, confidence, and study habits.

3. Eligibility, Parents, and Minor Students

Students under the age of majority must use Mathnk with consent and supervision from a parent or legal guardian. A parent or guardian may be required to create, verify, or manage the account for a minor student.

Parents and guardians are responsible for providing accurate student information, reviewing class expectations with the student, supervising appropriate use of online learning tools, and helping Mathnk resolve attendance, conduct, payment, or safety concerns.

Mathnk may refuse, pause, restrict, or terminate access if required consent is missing, if student safety or privacy is at risk, or if account information appears inaccurate, incomplete, or unauthorized.

4. Accounts, Verification, and Security

Some Mathnk services require an account. You agree to provide accurate registration, student, parent, guardian, contact, grade, subject, and billing information, and to keep that information current.

Mathnk may require email verification, parent or guardian verification, password setup, magic-link login, Google sign-in for verified accounts, or other account-security steps before workspace or class access is enabled.

You are responsible for keeping login credentials private and for all activity under your account. If you believe an account has been accessed without permission, contact Mathnk promptly.

Mathnk may create managed student identifiers where appropriate, including for minor students who do not have their own email address. Parent or guardian verification may be required before the student account can be used.

5. Free Assessments and Trial Access

Mathnk may offer a free assessment, intake session, or short trial class. Free assessment availability, format, subject, grade level, teacher assignment, and scheduling are subject to Mathnk's operational capacity.

A free assessment is intended to help Mathnk understand the student's level, goals, support needs, and suitable next steps. It does not guarantee admission to a particular class, teacher, time slot, package, or program.

Mathnk may limit free assessments to prevent abuse, including duplicate requests using the same email, guardian, student details, phone number, device, or other signals. Suspicious or duplicate requests may be blocked or flagged for review.

A free assessment or trial does not create a paid enrollment unless the family separately completes the enrollment and payment process.

6. Enrollments, Packages, Payments, and Auto-Pay

Paid access requires confirmed enrollment terms, including student, subject, grade or level, selected package, billing option, price, payment method, and any applicable discount or promotion.

Mathnk may offer monthly, annual, hourly, bundle, college, university, group, one-on-one, or subject-specific packages. Prices, discounts, package terms, and schedules may change, but changes will not alter a completed payment unless permitted by the agreed enrollment terms.

Payments are generally charged in advance. Where auto-pay or recurring billing is enabled, you authorize Mathnk and its payment provider to charge the payment method on file according to the selected package until cancelled or changed.

Discount codes are subject to validity dates, package restrictions, usage limits, and one-promotion-at-a-time rules. Mathnk may reject expired, unauthorized, transferred, manipulated, or incorrectly applied discounts.

If a payment fails, Mathnk may notify the parent or payer, provide a grace period where appropriate, pause future class access, or ask an administrator to review an override. Mathnk may also send reminders before upcoming renewal dates or card expiry dates.

7. Cancellations, Refunds, and 30-Day Guarantee

Families may request cancellation of future billing. Cancellation timing, continued access, and refund eligibility may depend on the selected package, billing period, classes delivered, teacher time reserved, and the payment provider's timelines.

Mathnk may offer a 30-day learning confidence guarantee for the first paid package. Refund or credit requests under this guarantee may be reviewed against attendance, student participation, feedback after sessions, teacher notes, conduct concerns, escalations, delivered classes, and payment status.

Low satisfaction feedback and unresolved support concerns may support a refund or credit review. Consistently high feedback followed by a refund request may require additional administrator review.

Mathnk may also expel or remove a student from group learning if attendance, conduct, focus, safety, or class disruption concerns prevent meaningful learning. In appropriate cases, Mathnk may recommend one-on-one support, parent involvement, a different class format, a credit, or a refund.

8. Scheduling, Attendance, and Class Conduct

Class schedules, teachers, backup teachers, Zoom or meeting links, recordings, and subject assignments are managed by Mathnk and may change for operational, safety, teacher-availability, or quality reasons.

Students are expected to attend on time, participate respectfully, keep the camera on unless a parent-approved written excuse is recorded, stay attentive, and avoid eating, lying down, distractions, harassment, or conduct that disrupts learning.

Teachers, teaching assistants, and administrators may record attendance, engagement, homework, class outcomes, conduct concerns, and support needs. Mathnk may share relevant class information with parents or guardians.

Mathnk may remove a student from a class, notify parents, pause access, or recommend a different learning format if the student repeatedly violates class expectations or creates a poor learning environment for others.

9. Recordings, Materials, and Student Work

Mathnk classes may be recorded when recording is enabled. Recordings may be made available to enrolled students and linked parents or guardians for learning review, subject to access controls and retention practices.

Students, parents, and other users may not record, copy, publish, share, distribute, sell, livestream, screenshot, or reuse Mathnk classes, recordings, teacher materials, student work, answer keys, model papers, or workspace content except as Mathnk expressly permits.

Mathnk may provide model papers, worksheets, homework, reviewed work, answer sheets, teacher notes, and other class materials. Answer sheets and teacher-only materials may be restricted and access may be logged.

Student-submitted answers, feedback, messages, homework, model paper attempts, and other learning activity may be stored, reviewed by teachers or administrators, returned to the student, or shared with linked parents or guardians where appropriate.

10. Student Workspace, AI Tools, and Academic Integrity

The Mathnk student workspace may include math views, coding tools, practice questions, graphing, hints, AI-supported guidance, progress tracking, model papers, reviewed work, recordings, and class resources.

AI-supported tools are learning aids and may be incomplete, inaccurate, or unsuitable for a particular assignment. Students should use teacher guidance, class materials, and their own reasoning, and should ask for help when unsure.

Students must not use Mathnk tools to cheat, impersonate another person, bypass assessment rules, submit copied work as their own, access restricted answer keys, interfere with monitoring, or misuse teacher or student materials.

Mathnk may use reasonable signals, logs, timestamps, answer patterns, teacher review, or other safeguards to support academic integrity, safety, and fair use.

11. Acceptable Use

You may use Mathnk only for lawful educational purposes and in accordance with these Terms, applicable policies, and instructions from Mathnk teachers or administrators.

You must not misuse Mathnk by attempting unauthorized access, sharing private links, scraping content, attacking systems, uploading malicious files, impersonating others, harassing users, exposing minors to inappropriate content, violating privacy, or interfering with classes or platform operations.

You must not post, submit, upload, or transmit content that is unlawful, harmful, threatening, abusive, discriminatory, defamatory, obscene, sexually explicit, exploitative of minors, invasive of privacy, infringing, misleading, spam, malicious code, or otherwise inappropriate for an educational environment.

Mathnk may remove content, restrict features, suspend access, or contact parents, guardians, administrators, payment providers, or authorities where appropriate.

12. Intellectual Property and Limited Licence

Mathnk owns or licenses the Mathnk name, logo, website, workspace, class materials, model papers, answer sheets, practice content, templates, software, designs, graphics, text, videos, recordings, and other content made available through Mathnk.

Subject to these Terms, Mathnk gives enrolled users a limited, revocable, non-exclusive, non-transferable licence to access Mathnk services and materials for personal educational use only.

You may not copy, modify, adapt, sell, sublicense, distribute, publish, reverse engineer, remove branding from, or create competing materials from Mathnk content except where Mathnk gives written permission.

If you provide suggestions, comments, ideas, or feedback about Mathnk, Mathnk may use that feedback to improve its services without compensation or obligation to you.

13. Privacy and Communications

Mathnk's collection, use, disclosure, retention, and protection of personal information is described in the Mathnk Privacy Policy. By using Mathnk, you acknowledge that Mathnk will process personal information as needed to provide and improve its services.

Mathnk may send service-related messages such as account verification, assessment scheduling, class reminders, payment confirmations, payment reminders, homework or model paper notices, recording availability, feedback requests, security notices, and support messages.

Marketing, SMS, and partner communications should be based on appropriate consent or another legally permitted basis. Where unsubscribe or withdrawal options are provided, Mathnk will process them according to applicable requirements.

14. Third-Party Services

Mathnk may use third-party services such as payment processors, email providers, meeting platforms, hosting providers, analytics, authentication providers, or AI tools to operate the services.

Third-party services may have their own terms, privacy practices, availability limits, account requirements, and technical issues. Mathnk is not responsible for third-party services that it does not control, but Mathnk will use reasonable efforts to manage provider issues that affect scheduled learning.

Links to third-party websites or tools are provided for convenience and do not mean Mathnk endorses all content, services, or policies on those third-party sites.

15. Availability and Changes

Mathnk aims to provide reliable access, but does not guarantee that the website, workspace, classes, recordings, payment systems, meeting links, AI tools, or communications will always be uninterrupted, error-free, or available.

Mathnk may update, suspend, replace, remove, or discontinue features, content, classes, schedules, teachers, pricing, packages, or services where needed for quality, safety, legal, technical, or business reasons.

Mathnk may update these Terms by posting revised terms on the website or by giving notice where appropriate. Continued use after changes means you accept the updated Terms.

16. Disclaimers

Mathnk services are provided for educational support. Mathnk does not guarantee grades, admissions, scholarships, test scores, school outcomes, employment outcomes, or any specific academic result.

To the maximum extent permitted by applicable law, Mathnk services and content are provided on an as-is and as-available basis without warranties of any kind, whether express, implied, statutory, or otherwise.

Some jurisdictions do not allow certain warranty limitations, so parts of this section may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Mathnk will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, service interruptions, third-party platform issues, or unauthorized access beyond Mathnk's reasonable control.

To the maximum extent permitted by applicable law, Mathnk's total liability for claims related to the services will not exceed the amount paid to Mathnk for the specific service giving rise to the claim during the three months before the claim arose, or one hundred Canadian dollars, whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Indemnity

You agree to defend, indemnify, and hold Mathnk harmless from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of Mathnk, your breach of these Terms, your violation of law, your infringement of another person's rights, your submitted content, or your student's conduct where you are responsible as parent or guardian.

Mathnk may control the defence of any matter subject to indemnification, and you agree to cooperate reasonably with Mathnk in that defence.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules.

Before starting a formal claim, you agree to contact Mathnk so both sides can try to resolve the issue informally. If the issue cannot be resolved informally, disputes may be brought in the courts located in Ontario, unless applicable law requires another forum.

Nothing in these Terms prevents Mathnk from seeking urgent or injunctive relief to protect students, privacy, safety, intellectual property, platform security, or service integrity.

20. General Terms

If any part of these Terms is found unenforceable, the remaining parts will continue to apply. Mathnk's failure to enforce a term does not waive its right to enforce that term later.

You may not assign your rights or obligations under these Terms without Mathnk's consent. Mathnk may assign or transfer these Terms as part of a reorganization, merger, sale, or transfer of the business.

These Terms, together with the Privacy Policy, free assessment terms, enrollment or checkout terms, and any additional terms shown during registration or purchase, form the agreement between you and Mathnk for use of the services.
